City election qualifying period ends with no qualified candidates
When the qualifying period ended for city of Ocala elections at noon on Friday, July 11, every candidate failed to comply with at least one aspect of Fla. Stat. 106.11.1, which outlines who signs campaign checks and what information those campaign checks should contain.
For example, some candidates including Mayor Ben Marciano and City Council member Barry Mansfield signed checks from their campaign accounts but had not identified themselves as the treasurers of their campaigns.
Council member James Hilty issued a check for campaign fees as the designated treasurer, but there was a question about whether he included enough information on the checks memo line for the exact purpose for which the expenditure is authorized.
Other candidates offered cashiers checks, and those arent acceptable forms of payment since the statute requires that candidates shall make expenditures from funds on deposit in the primary campaign depository only by means of a bank check drawn upon the campaign account.
