The Trump administration on Wednesday received some clarity over its much-stalled efforts to relaunch the mass deportation of Latin American immigrants using the Alien Enemies Act (AEA).

In a 15-page opinion, U.S. District Judge Stephanie L. Haines, appointed by President Donald Trump during his first term, signed off on a plan for a 21-day period in which would-be detainees are made aware of their potential deportations under the obscure 18th-century wartime law.

In the underlying case, the petitioner is a Venezuelan migrant identified in court documents as "W.J.C.C." who sought to vindicate the 21-day notice period and also to prevent the government from taking him outside the jurisdiction of the Western District of Pennsylvania. The court signed off on the petitioner's first request regarding the notice period, while denying his request to enjoin the government from moving him to another detention facility.

While the details of the case are largely unknown, with most of the filings under seal, the government opposed both requests. Haines, for her part, said she was simply requiring the government to bring its standards in line with a case she decided early last month.

What about the prior judicial decisions that found that the AEA doesn't apply to these deportations because we're not at war with another country? Another judge in his pocket.

is the ONLY ONE so far who didn't reject the use of the "Alien Enemies Act". All the rest have done so however... at least to date.

as they have had cases involving the illegal deportation without due process but haven't directly ruled on the actual use of the "Alien Enemies Act" for that purpose yet.

drink. It will take patience, but judges and attorneys have to keep hammering from all directions to put a chink in the incredible armor protecting the current administration.
