The capture of law enforcement is the penultimate step in ending American democracy.

Mike Brock describes the systematic use of manufactured evidence and ongoing capture and repurposing of law enforcement: https://www.notesfromthecircus.com/p/the-reactionary-coup-of-america-continues

The Trump administration has moved beyond isolated corruption to the systematic manufacture of evidence as standard operating procedure. Whistleblower emails show government officials explicitly asking “Can we say this guy is a leader of MS-13?” before having any evidence to support the claim. When they continue calling someone a terrorist after their own investigators find no proof of gang membership, when they fire career prosecutors for demanding adherence to facts and law—we’re looking at a regime that is systematically abandoning the rule of law.

The Kilmar Abrego Garcia case reveals how this corruption operates. Whistleblower emails show Trump administration officials desperately searching for evidence to justify calling Abrego Garcia an MS-13 “leader” after they had already made the claim. When ICE investigators responded “I have not found anything indicating ‘leader,’ but I’ll keep looking,” the administration simply ignored the lack of evidence and continued the propaganda campaign. When Justice Department lawyer Erez Reuveni refused to sign legal briefs without evidentiary support, he was fired for “failing to zealously advocate on behalf of the United States.”

But the most revealing aspect demonstrates how rapidly the justice system is being captured. Emil Bove, the Trump loyalist who allegedly ordered DOJ attorneys to tell courts “f*** you” when they demanded compliance with judicial orders, has been confirmed to a lifetime appointment as a federal appeals court judge. Text messages between Justice Department officials explicitly reference Bove’s alleged directive to defy court orders, yet Senator Thom Tillis—the swing vote on the Judiciary Committee—casually announced he would support the nomination based on his “staff recommendation.”

The systematic manufacture of evidence is becoming the new operating principle of American law enforcement. This transformation accelerates with each confirmation, each dismissal, each manufactured case. The question is whether we will acknowledge this reality and respond before the capture becomes irreversible.

When the DOJ, the military, the masked secret police (ICE) and local law enforcement become instruments of executive orders only one step to full dictatorship remains: rigged elections

Edit: Brock incorrectly (at this time) describes Bove's appointment as confirmed.

The quote is the quote. Hopefully it's not prescient. As a betting person though, I expect it is. Tillis' courage didn't extend to actually helping stop the coup.

5. A whistleblower came forward yesterday.

(CBS) "A week before an expected committee vote on the controversial nomination of Trump ally Emil Bove for a federal judgeship, CBS News has obtained emails and text messages shared with Congress by a whistleblower who accuses Bove of unethical actions while he was a top Justice Department official this year."

"The messages were released Thursday morning by Senate Judiciary Committee Democrats who are trying to defeat Bove's nomination for a judicial appointment to the Third Circuit U.S. Court of Appeals. The text and email messages allegedly offer new insight into the administration's response to its mistaken deportation of Kilmar Abrego Garcia from Maryland to El Salvador on March 15."

"The whistleblower is former Justice Department attorney Erez Reuveni, who was fired April 11, after more than 14 years at the agency, when department leadership accused him of presenting an insufficiently vigorous argument on behalf of the Trump administration during Abrego Garcia's court proceedings."

"Last month, Reuveni issued a public statement opposing the nomination of Bove, who is one of Mr. Trump's former criminal defense lawyers."

"The text and email messages, which were obtained by Democratic leadership on the Senate Judiciary Committee, show Reuveni unsuccessfully pressed his colleagues and other federal agencies for assistance in fulfilling a court order that Abrego Garcia be returned to the U.S. in March. Dozens of the email messages also allegedly reveal attempts by Trump administration officials to label Abrego Garcia a leader of the gang MS-13 — which Abrego Garcia's lawyers have strongly denied — and downplay the agency's mistake in removing him to El Salvador."

The Third Reich was a police state characterized by arbitrary arrest and imprisonment of political and ideological opponents in concentration camps.

With the reinterpretation of "protective custody" (Schutzhaft) in 1933, police power became independent of judicial controls. In Nazi terminology, protective custody meant the arrest—without judicial review—of real and potential opponents of the regime. "Protective custody" prisoners were not confined within the normal prison system but in concentration camps under the exclusive authority of the SS (Schutzstaffel; the elite guard of the Nazi state).

The Third Reich has been called a dual state, since the normal judicial system coexisted with the arbitrary power of Hitler and the police. Yet, like most areas of public life after the Nazi rise to power in 1933, the German system of justice underwent "coordination" (alignment with Nazi goals). All professional associations involved with the administration of justice were merged into the National Socialist League of German Jurists. In April 1933, Hitler passed one of the earliest antisemitic laws, purging Jewish and also Socialist judges, lawyers, and other court officers from their professions. Further, the Academy of German Law and Nazi legal theorists, such as Carl Schmitt, advocated the nazification of German law, cleansing it of "Jewish influence." Judges were enjoined to let "healthy folk sentiment" (gesundes Volksempfinden) guide them in their decisions.

Hitler determined to increase the political reliability of the courts. In 1933 he established special courts throughout Germany to try politically sensitive cases. Dissatisfied with the 'not guilty' verdicts rendered by the Supreme Court (Reichsgericht) in the Reichstag Fire Trial, Hitler ordered the creation of the People's Court (Volksgerichtshof) in Berlin in 1934 to try treason and other important "political cases." Under Roland Freisler, the People's Court became part of the Nazi system of terror, condemning tens of thousands of people as "Volk Vermin" and thousands more to death for "Volk Treason." The trial and sentencing of those accused of complicity in the July Plot, the attempt to kill Hitler in July 1944, was especially unjust.
