Early Bird employee who was arrested by ICE in Omaha indicted on 3 charges

The Early Bird employee who was tackled and arrested by U.S. Immigration and Customs Enforcement agents at a west Omaha restaurant earlier this month, appeared in federal court Monday.

A grand jury indicted Romeo Edilzar Yaxcal-Tiul with false representation of a Social Security number and use of false immigration identification documents in October 2024, according to court documents. He was also charged with forcibly resisting, opposing, impeding and interfering with a federal officer on June 1, when he was detained.

An Omaha couple eating breakfast at Early Bird witnessed ICE agents hopping over the railing of the restaurant’s patio and tackling Yaxcal-Tiul.

The agents were dressed in tactical gear, their faces covered.
