Previously deported in 2023 and came back. I believe that is a felony

ICE has not explained why Romero was arrested Thursday morning, but Kevin said she was undocumented and had been deported once in 2023.

"She actually wasn't in the process of asylum," he said through an interpreter. "She technically doesn't have process right now. She had technically deported before. Because of her son, she had made the choice to come back."
